Qualify as a Chartered Legal Executive specialising in criminal litigation. Study online around your job, put your deep study into criminal law only, and work towards independent criminal litigation practice rights. 

A Chartered Legal Executive Litigator specialising in criminal litigation advises and represents clients facing criminal investigation or prosecution.

They prepare cases for court by gathering, reviewing, and analysing evidence, interviewing witnesses, drafting legal documents such as case summaries, defence statements, and mitigation, and liaising with agencies including the police and the Crown Prosecution Service. They support clients throughout the criminal justice process, ensuring they understand their rights, the procedures involved, and the potential outcomes, while working to build a robust defence or present the case effectively on their behalf. 

With additional accreditation, they can attend police stations to advise and represent clients during interviews under caution. Where they hold rights of audience, through qualification as a Chartered Legal Executive Litigator and Advocate, they may also appear in court to represent clients at appropriate hearings.

Where this takes you

Once authorised by CILEX Regulation, you can practise independently in criminal litigation, running your own cases as the lawyer, not supporting someone else’s, and you can add additional practice rights:

  • On authorisation: criminal litigation practice rights – Conduct criminal litigation independently as a Chartered Legal Executive Litigator (Criminal Litigation). You will also be authorised as a Commissioner for Oaths, a right awarded on qualification as a Chartered Legal Executive.
  • Add advocacy: rights of audience – Apply for Advocacy Practice Rights and complete the required accredited Advocacy Skills Course to gain rights of audience in criminal proceedings. Once authorised, you can practise as a Chartered Legal Executive Litigator and Advocate (Criminal Litigation).
  • Go further: Higher Rights of Audience – Following the first renewal of your advocacy certificate, you can undertake additional Higher Rights of Audience training and assessment to seek authorisation for higher court advocacy in criminal proceedings.

CILEX Regulation sets out five steps to becoming an authorised Chartered Legal Executive Litigation in Criminal Litigation. This course is step 1, and your day job carries you through steps 2 to 4 while you study.

Claire Smith: I was a Met Police Community Support Officer when I first started studying. As there is no progression in this role, my career wasn’t going anywhere and so I decided to study CILEX Level 3 Diploma in Law and Practice. I had some experience with CILEX because I did a Legal Secretary course 12 years earlier.

Entry requirements

  • There is no single entry route, it depends on your legal education and experience so far. Typical routes in: a law degree, GDL or LPC, CILEX Legacy or CPQ qualifications, SQE. Not sure where you fit? Tell us your background and we can help to map your route, including anything you can skip.

Exemptions: You may be closer to authorisation than you think

  • Already gained some legal qualifications? You may not need the full pathway. Law degrees, CILEX qualifications and prior legal training can all earn exemptions, so tell us what you hold and we will confirm what you are exempt from.
